Migrants’ Maternity Leave

URGENT PRESS RELEASE, 26 June 2012

On June the 25th, 2012, MCOT reported that the Minister of Labour is drafting legislation that will allow pregnant migrant women to return to their country of origin when they are three to four months pregnant. After giving birth, they can come back to Thailand to start working again.

This policy is being enacted following the release of the US State Department’s 2012 Trafficking in Persons (TIP) report which placed Thailand on the watch list of Tier 2 for the third time running.

According to the MCOT, the Minister thought this policy would prevent trafficking of children.

Mekong Migration Network (MMN) congratulates the Thai government for extending the length of paid maternity leave for migrant women. We assume that migrant women will be entitled to 9 months paid maternity leave as they will be required to take maternity leave from the fourth month of pregnancy until 3 months after giving birth. We also expect the Thai government to provide free of charge appropriate transportation to their home and back to work in Thailand.

Or is it possible that Thailand is so desperate to appease the anti trafficking lobbyists, that it is sacrificing women’s fundamental rights by deporting pregnant women?

แรงงานหญิงข้ามชาติลาคลอดได้ 9 เดือน?

แถลงการณ์ด่วน วันที่ 26 มิถุนายน พ.ศ. 2555

จากการรายงานข่าวของสำนักข่าวไทย เมื่อวันที่ 25 มิถุนายน 2555 ซึ่งรายงานว่ารัฐมนตรีว่าการกระทรวงแรงงาน นายเผดิมชัย สะสมทรัพย์ กล่าวว่าได้ให้กรมสวัสดิการและคุ้มครองแรงงาน จัดทำร่างระเบียบให้แรงงานข้ามหญิงข้ามชาติที่เข้ามาทำงานในไทยที่ตั้งครรภ์อายุ 3 เดือน สามารถกลับไปคลอดบุตรที่ประเทศต้นทาง และกลับเข้ามาทำงานได้ตามเดิม

ซึ่งนโยบายนี้เพื่อแก้ปัญหาหลังจากที่ทางการสหรัฐจัดอันดับประเทศที่มีความพยายามในการแก้ไขปัญหาการค้ามนุษย์ โดยให้ไทยเป็นประเทศที่ต้องจับตามอง ระดับ 2.5 (Tier 2 Watch list) เป็นปีที่ 3 ติดต่อกันในรายงานเกี่ยวกับสถานการณ์การค้ามนุษย์ (ทีไอพี) ประจำปี 2555 โดยตามข่าวจากสำนักข่าวไทยดูเหมือนว่ารัฐมนตรีว่าการกระทรวงแรงงานจะคิดว่าการมีนโยบายดังกล่าวจะสามารถป้องกันการค้าเด็ก

เครือข่ายการย้ายถิ่นในอนุภูมิภาคลุ่มน้ำโขง (MMN) ขอแสดงความยินดีกับรัฐบาลไทยในการขยายระยะเวลาในการลาคลอดของแรงงานหญิงข้ามชาติ เราสันนิษฐานว่าแรงงานหญิงข้ามชาติจะได้รับสิทธิในการลาคลอดเป็นจำนวน 9 เดือนโดยได้รับค่าจ้างเต็มจำนวนทั้งนี้เพราะพวกเธอต้องลางานตั้งแต่ระยะที่ตั้งครรภ์ได้ 4 เดือนจนถึงหลังการคลอดอีก 3 เดือน อีกทั้งเราหวังว่ารัฐบาลไทยจะจัดให้มีพาหนะที่เหมาะสมในการจัดส่งแรงงานหญิงกลับประเทศต้นทางและกลับมาสถานที่ทำงานในประเทศไทยโดยไม่คิดค่าบริการ

ทว่าจะเป็นไปได้หรือไม่ว่านี่เป็นนโยบายเข้าตาจนของประเทศไทยที่จะสนองตอบต่อล็อบบี้ยีสต์ที่ต่อต้านการค้ามนุษย์ จนกระทั่งต้องสังเวยด้วยสิทธิขั้นพื้นฐานที่สำคัญของผู้หญิง ด้วยการบังคับส่งแรงงานหญิงข้ามชาติที่ตั้งครรภ์กลับประเทศต้นทาง
