Challenging Immigration: From Asia to Europe
\n<\/span>MMN Workshop at the 9th Asia-Europe People\u2019s Forum<\/span><\/h3>\nOn 16 \u2013 19 November, the Mekong Migration Network (MMN) attended the 9th<\/sup> Asia-Europe People\u2019s Forum (AEPF) in Vientiane, Laos.<\/span>\u00a0<\/span><\/p>\nMMN <\/span>organised<\/span> a workshop entitled \u201cChallenging Immigration Detention: From Asia to Europe<\/em>\u201d <\/span>in collaboration <\/span>with Global Detention Project (GDP) and National University of Laos (NU<\/span>O<\/span>L),<\/span><\/span><\/p>\nIn attendance at the workshop were participants <\/span>representing civil society organisations and mass organisations from<\/span> Asia and Europe<\/span>. <\/span>,<\/span><\/span><\/p>\nThe workshop started with a participatory activity where participants shared about trends of immigration detention in their respective countries. It was followed by a round table discussion, where representatives from MMN, GDP and NUOL provided<\/span> an overview of: trends relating to immigration detention in Europe<\/span> and categorization of various types of immigration detention<\/span>; immigration detention<\/span> and deportation<\/span> practices in Thailand; and <\/span>the roles of migrant countries of origin in providing assistance to its nationals who are detained <\/span>.<\/span><\/span><\/p>\nAcross the globe, detention is <\/span>used<\/span> to government efforts to control global migration. This is despite evidence that suggests that the use of detention does little to deter would-be migrants, and detrimental to the health and wellbeing of detainees.<\/span><\/span><\/p>\nRecommendations arising from the workshop addressed to governments attending Asia Europe Summit were:<\/span><\/p>\n1.\u00a0\u00a0\u00a0 <\/span><\/span>Governments shall ensure that immigration detention is used only as a LAST RESORT. <\/o:p><\/span><\/span><\/p>\n2.\u00a0<\/span><\/span>Governments shall not detain vulnerable migrants, including: children, asylum seekers, pregnant women, the elderly, people with disabilities, people with special medical needs, or victims of trafficking.<\/o:p><\/span><\/span><\/p>\n3.\u00a0\u00a0\u00a0 <\/span><\/span>Any recourse to detention shall conform with fundamental human rights principles, including:<\/o:p><\/span><\/span><\/p>\n\u00b7\u00a0\u00a0\u00a0<\/span><\/span>provision of health care, information about the reasons for detention in a language the person understands, legal assistance, recreation, and adequate food and water;<\/o:p><\/span><\/span><\/p>\n\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>freedom from ill-treatment (including physical and psychological abuse);<\/o:p><\/span><\/span><\/p>\n\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>not to be detained alongside criminal prisoners;<\/o:p><\/span><\/span><\/p>\n\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>ability to challenge detention in appropriate legal setting;<\/o:p><\/span><\/span><\/p>\n\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>contact with outside world, including family members and consular representatives.<\/o:p><\/span><\/span><\/p>\n4.<\/span>\u00a0 \u00a0 \u00a0<\/font><\/span>Governments shall adopt alternatives to detention for managing its irregular migrant population. <\/o:p><\/span><\/span><\/p>\n5.\u00a0\u00a0<\/span><\/span>Authorities of migrants\u2019 countries of origin shall provide consular assistance and other appropriate support when it is requested by its nationals.<\/o:p><\/span><\/span><\/p>\n6.\u00a0\u00a0<\/span><\/span>Authorities of the countries of origin shall pressure detaining countries to treat detained migrants humanely and lawfully.<\/o:p><\/span><\/span><\/p>\n7.<\/span>\u00a0<\/font><\/span>Governments shall not pressure neighbouring countries to detain transiting migrants and asylum seekers.<\/span><\/span><\/p>\nThe final declaration of the 9th<\/sup> AEPF, which <\/span>has only partially incorporated<\/span> MMN\u2019s recommendations, is available at:<\/span><\/span><\/p>\nhttp:\/\/aepf.info\/aepf9\/94-final-declaration-9th-asia-europe-people-s-forum-vientiane-laos<\/span><\/p>\nThe AEPF statement unfortunately does not capture the substance of the recommendation coming out of the MMN workshop and misses the important issues about immigration detention. \u00a0<\/span>MMN affirms its original recommendations<\/span>, <\/span>calls for renewed efforts to challenge immigration detention, in Asia, Europe, and the rest of the world.\u00a0<\/o:p><\/span><\/span><\/p>\n<\/p>\n

MMN <\/span>organised<\/span> a workshop entitled \u201cChallenging Immigration Detention: From Asia to Europe<\/em>\u201d <\/span>in collaboration <\/span>with Global Detention Project (GDP) and National University of Laos (NU<\/span>O<\/span>L),<\/span><\/span><\/p>\n In attendance at the workshop were participants <\/span>representing civil society organisations and mass organisations from<\/span> Asia and Europe<\/span>. <\/span>,<\/span><\/span><\/p>\n The workshop started with a participatory activity where participants shared about trends of immigration detention in their respective countries. It was followed by a round table discussion, where representatives from MMN, GDP and NUOL provided<\/span> an overview of: trends relating to immigration detention in Europe<\/span> and categorization of various types of immigration detention<\/span>; immigration detention<\/span> and deportation<\/span> practices in Thailand; and <\/span>the roles of migrant countries of origin in providing assistance to its nationals who are detained <\/span>.<\/span><\/span><\/p>\n Across the globe, detention is <\/span>used<\/span> to government efforts to control global migration. This is despite evidence that suggests that the use of detention does little to deter would-be migrants, and detrimental to the health and wellbeing of detainees.<\/span><\/span><\/p>\n Recommendations arising from the workshop addressed to governments attending Asia Europe Summit were:<\/span><\/p>\n 1.\u00a0\u00a0\u00a0 <\/span><\/span>Governments shall ensure that immigration detention is used only as a LAST RESORT. 2.\u00a0<\/span><\/span>Governments shall not detain vulnerable migrants, including: children, asylum seekers, pregnant women, the elderly, people with disabilities, people with special medical needs, or victims of trafficking. 3.\u00a0\u00a0\u00a0 <\/span><\/span>Any recourse to detention shall conform with fundamental human rights principles, including: \u00b7\u00a0\u00a0\u00a0<\/span><\/span>provision of health care, information about the reasons for detention in a language the person understands, legal assistance, recreation, and adequate food and water; \u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>freedom from ill-treatment (including physical and psychological abuse); \u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>not to be detained alongside criminal prisoners; \u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>ability to challenge detention in appropriate legal setting; \u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>contact with outside world, including family members and consular representatives. 4.<\/span>\u00a0 \u00a0 \u00a0<\/font><\/span>Governments shall adopt alternatives to detention for managing its irregular migrant population. 5.\u00a0\u00a0<\/span><\/span>Authorities of migrants\u2019 countries of origin shall provide consular assistance and other appropriate support when it is requested by its nationals. 6.\u00a0\u00a0<\/span><\/span>Authorities of the countries of origin shall pressure detaining countries to treat detained migrants humanely and lawfully. 7.<\/span>\u00a0<\/font><\/span>Governments shall not pressure neighbouring countries to detain transiting migrants and asylum seekers.<\/span><\/span><\/p>\n The final declaration of the 9th<\/sup> AEPF, which <\/span>has only partially incorporated<\/span> MMN\u2019s recommendations, is available of the recommendation coming out of the MMN workshop and misses the important issues about immigration detention. \u00a0<\/span>MMN affirms its original recommendations<\/span>, <\/span>calls for
